로아시아(LAWASIA)는 지난 6월 9일 발생한 법률사무소 방화테러 사건 관련, '한국의 변호사 방화 사건을 규탄하는 성명서(LAWASIA STATEMENT CONDEMNING THE ARSON ATTACK ON LAWYERS IN KOREA)'를 지난달 30일 발표했다.

로아시아는 "2022년 6월 9일 대한민국 대구의 한 법률사무소에서 발생한 최근 방화 사건에 대해 중대한 우려를 표명한다"며 "대한변협은 방화 사건 피해자 유족에게 깊은 애도를 표하고, 추후 변호사에 대한 정서적 적대감과 물리적인 공격을 방지할 수 있는 방법을 구체적으로 마련할 것을 (정부와 국회에) 강력히 촉구했다"고 밝혔다.

이어 "모든 분야와 전문 분야의 변호사들은 고객의 이익을 증진하고 보호하기 위해 최선을 다해 성실하게 행동하며, 이는 문명 사회에서 사회 정의와 안정성의 기반을 이룬다"며 "법조계를 겨냥한 폭력과 테러는 무고한 생명을 위협할 뿐만 아니라 근본적으로 법치를 위협한다"고 비판했다.

또 "안타깝게도 변호사에 대한 폭력 사건은 세계 전역에서 들려오고 있다"며 "로아시아는 법조계에 대한 모든 공격을 법의 지배와 사법 행정에 대한 직접적인 모욕으로 간주한다"고 강조했다.

그러면서 "변호사는 사적 및 직업적 영역의 안녕에 대한 위협이나 두려움 없이 직업적 의무와 책임을 수행할 권리가 있다"며 "변호사의 이러한 권리는 우리 사법 체계, 법 집행 및 지역 사회 보호의 기반"이라고 했다.

로아시아는 아시아 태평양 50여 개 국가의 판사·검사·변호사·법학자 등 1500여 명이 가입된 국제 법률가단체다.

이에 대해 변협은 "법률사무소 방화테러 희생자와 피해자 모두에게 다시 한번 깊은 애도와 위로의 뜻을 전하며, 법치주의의 근간을 뒤흔드는 모든 물리력으로부터 변호사들의 안전을 담보하기 위해 앞으로도 최선의 노력을 다해나갈 것"이라고 밝혔다.

이번 로아시아의 성명 발표는 기관 회원으로 참여하고 있는 대한변호사협회(협회장 이종엽)의 요청으로 진행됐다.

LAWASIA, the Law Association for Asia and the Pacific, is an association of legal organizations, lawyers, judges and jurists who advocate to promote social justice and rule of law principles in Asia and the Pacific region. The Association aims to promote and support the administration of justice and the maintenance of the rule of law.

LAWASIA expresses its grave concern regarding a recent arson attack at a law office in Daegu, South Korea, on June 9, 2022. It appears that the incident, in which seven people died and 49 were injured, was instigated by a disaffected client who also died in the fire. The Korean Bar Association, a member organisation of LAWASIA, has expressed its deep condolences to the families of the victims and strongly urged that specific consideration be given as to how emotionally driven hostility and physical attacks against lawyers can be prevented in future.

LAWASIA shares the concern of the Korean Bar Association regarding this incident. The violence and terrorist activity directed against the legal profession not only jeopardises innocent lives but also fundamentally threatens the rule of law. Lawyers from all fields and all specialties act in good faith and to the best of their ability to promote and protect their clients' interests, and this in turn is fundamental to our concept of justice and stability in civilized society.

Unfortunately, incidents of violence against lawyers are reported from across the region from time to time. LAWASIA views any assault on the legal profession to be a direct affront to the rule of law and the administration of justice. Lawyers have the right to perform their professional duties and obligations without intimidation or fear for their personal and professional wellbeing. It is fundamental to our system of justice, the practice of law, and the protection of the community.
