대한변협신문 독자들에게 간단한 소개 부탁드립니다.

저는 상파울루에서 일하고 있는 브라질 변호사입니다. 1977년 대학을 졸업하고 얼마 되지 않아 독일에서 일하게 됐습니다. 독일에서 약 4년이 넘는 기간 동안 일하고 영국 런던 로펌에서 일했습니다. 독일에서 변호사로서 일하면서 동시에 쾰른대학교(Universitat zu Koln)에서 LL.M. 과정과 유사한 학업을 이수했습니다.

그리고 리우데자네이루에서 11년을 보냈습니다. 리우데자네이루에서 시작한 로펌은 성공적으로 성장했고 상파울루에도 사무실을 두게 됐습니다. 상파울루의 사무실이 커지면서 저도 상파울루로 이동했습니다. 이후에 Motta Fernandes 로펌과 합병을 하게 됐고 아직까지 이곳에서 일하고 있습니다.

제 회무 경험은 세계청년변호사협회(이하 ‘AIJA’)에서 일하게 된 것으로 시작했습니다. AIJA는 프랑스어로 Internationale des Jeunes Avocats의 약자입니다. AIJA는 보통 45세까지 회원이 될 수 있습니다. 마지막으로 AIJA의 회장을 역임했습니다. 그 후에는 IBA에 정기적으로 참석하기 시작했습니다. IBA의 Bar Issues Commission에서 위원장을 맡은 뒤로 사무총장, 부회장까지 지내왔고, 이번 해 로마에서 차기 회장으로 선출되어 내년부터는 세계변호사협회(이하 ‘IBA’) 회장으로서 일하게 됩니다.

 

어떤 이유로 여러 국제 협회에 참여하시게 되었나요?

우선 저는 개인적으로 항상 국제적인 고객을 상대하는 변호사가 되길 원했습니다. 그리고 두 번째로 저는 언어를 배우는 것을 좋아합니다.

다양한 나라에서 일했던 경험으로 6개국어를 구사하고 있습니다. 저는 이런 협회활동에 참여하는 것이 국제 무대에서 전문성을 쌓는데 도움이 될 것이라고 생각했습니다. 그리고 실제로 그랬습니다. 제 고객의 상당수가 IBA에서 만난 동료들의 추천으로 저를 알게 되어 저에게 업무를 의뢰했습니다.

직업적으로 보탬이 되는 것 외에도 직역 자체에 관련된 주제들에 관심을 갖게 됐습니다.

한번 IBA 또는 다른 국제적 협회에 활동해보고 좋다고 생각하면 계속 참여하게 될 것입니다. 왜냐하면 그 조직을 중심으로 관계가 형성되기 때문입니다. 저의 경우도 저의 가장 친한 친구들 중 대부분이 IBA에서 만난 동료입니다.

 

IBA 만이 갖고 있는 특별한 특징은 무엇이 있나요? 그리고 IBA에서 경험하신 일 중 가장 기억에 남는 일은 무엇인가요?

제가 처음 IBA 총회에 갔을 때 저의 관심을 끈 것은 무한한 가능성입니다. 저에게 일을 줄 수 있는 많은 사람들을 만날 수 있는 기회의 장처럼 느껴졌기 때문입니다. 그러나 IBA에 참여하게 됐을 때 직역에 관하여 일하는 것도 굉장히 매력적으로 다가왔습니다.

IBA에서 가장 기억에 남는 것 중에 하나는 올해 있었던 로마 총회입니다. 그리고 이번에 서울에 방문하게 된 것도 굉장한 경험이었습니다. 그리고 도쿄에 방문했을 때 일본의 천황과 황후를 만났던 것을 얘기할 수 있습니다. 10분 정도 대화를 나누었는데, 그들은 저에게 굉장히 친절했고 우리는 함께 웃고 얘기할 수 있었습니다. 이 정도가 IBA에서 기억에 남는 경험이라고 할 수 있을 것 같습니다.

 

회장으로서 가장 중요하게 추진하고자 생각하시는 의제가 있다면 무엇입니까?

가장 우선적인 과제는 다양성과 포괄성확대입니다. 제가 여기서 다양성이라고 하는 것은 수락의 의미가 아니라 포괄성 차원의 다양성을 의미합니다. 지금 세계적으로 수 많은 여성변호사 또는 소수집단 출신의 변호사들이 일하고 있습니다. 그러나 지도적인 자리, 로펌이나 변호사협회의 임원진의 위치에 있는 여성변호사를 찾긴 어려운 편이고 이는 소수집단 출신의 변호사도 마찬가지 입니다. 저는 그들을 포함하여야 하는 시기가 왔다고 생각합니다.

그리고 이민자 문제도 다루고 싶습니다. 브라질을 포함해서 세계 곳곳이 이민자 문제와 관련하여 큰 위기 상황에 처해있다고 생각합니다. 이탈리아에서는 변호사협회가 무료로 이민자들에게 법률자문을 제공하고 있습니다. 만약 모든 변호사협회가 그렇게 한다면 엄청난 변화를 가져올 것입니다.

또한 당연히 법의 지배(rule of law)를 위한 노력도 계속할 것입니다. 법의 지배는 세계적으로 많은 위협에 직면하고 있습니다. 단순히 변호사여서가 아니라 법의 지배가 아니라면 이 직역이 존재할 수 없다는 측면에서 변호사로서 법의 지배를 수호하는 것이 필수적이라고 생각됩니다.

그리고 국제 무역 문제나 미성년자 납치 문제에도 특별히 관심이 있습니다.

 

한국에 있는 변호사들에게 내년 서울 총회에서 무엇을 기대할 수 있는지 설명해주십시오.

서울 총회 조직위원회는 서울 총회가 성공적으로 개최 될 수 있도록 필요한 모든 노력을 다할 것입니다. 처음 한국에서 열리는 큰 행사이기 때문에 한국으로서도 굉장히 특별한 경험이 될 것입니다. 미래에 IBA 총회가 다시 한국에서 열리게 되는 기회가 있겠지만 총회 장소를 선정하는데 세계 각 지역을 번갈아 가면서 정하는 것을 고려하면 아주 가까운 미래에 다시 없을 기회가 될 것입니다.

그리고 한국 변호사들에게 내년 총회는 세계 각국의 변호사들을 만날 수 있는 엄청난 기회가 될 것입니다. 올해 로마 총회는 70여 국가에서 약 6400명이 참석했습니다. 그리고 서울도 그 정도 규모의 참석 인원이 될 것이라고 기대하고 있습니다. 참석 여부를 고민하고 계신 한국변호사분들에게는 내년이야말로 IBA를 체험할 수 있는 아주 좋은 기회가 될 것입니다. 조직위원회의 결정에 따라 필요한 경우에는 통역이 제공되기도 하니 언어 장벽은 크게 문제되지 않을 것입니다. 거의 모든 위원회가 준비하는 워크숍도 매력적이고 즐거운 시간이 될 것입니다.

Q:Please tell the readers of KBA newspaper briefly about yourself.

A: I am a Brazilian lawyer practicing in San Paulo. I graduated in 1977 and shortly after, I went to work in Germany for a law firm that had clients in South and Latin America. I spent 4 years in Germany and then went to London to work for a Latin American association of law firms. I also did post-graduation work in Germany at the Universitat zu Koln.

Shortly after that I went to Rio de Janeiro where I spent 11 years and founded together with other partners the Rio de Janeiro office of a traditional São Paulo firm. After some years we moved to the São Paulo office. 20 years from when I was born and raised in San Paulo, I came back to San Paulo to work after having lived in Germany, UK, and Rio de Janeiro. At that time we incorporated a new law firm that merged with the law firm Motta Fernandes back in 2011, which is a very old and traditional law firm in Brazil, been around for more than 60 years, and very much specialized in business, capital markets, and corporate work. This is my professional part of the story.

As for the International Bar Association part, shortly after becoming a lawyer I became aware of international bar associations, so I started to work for the AIJA, an association for young lawyers, Association Internationale des Jeunes Avocats in French. AIJA is an association which you normally stay until you are 45. I put into a lot of efforts and at the end, before leaving AIJA, I served as its president. After my presidency at the AIJA, I started going to IBA regularly. I was also one of the founders of Latin American Forum at the IBA and I was chair of many committees and commissions. At the end I became the chair of the Bar Issues Commission. After that I was elected Secretary General, and Vice President, and now in Rome I was elected the President of IBA and should take in charge January next year.

 

Q:What made you get involved in international bar associations?

A:First of all, my internal motivation was that I have always wanted to be a lawyer who deals with international clients. Secondly, I always enjoyed learning languages. I have learned 6 languages in the course of my life. I thought it was a good way for me to start my international legal practice by joining these bar associations. It turned out to be true. My professional life has been built upon the IBA. I get a big majority of clients referred by my friends whom I have met in IBA. In my opinion I think that for countries like Korea, Brazil, which has big economic activities, it is very important to meet lawyers, because lawyers send you works. I can say that the professional desire was what made me start participating in IBA.

On top of having all these referrals, I also started to have great interest in subjects regarding the profession, ethical issues, rule of law, human rights and etc. I started to work with that as well. It was natural for me to diversify my attention to bar issues. Once you go to the IBA, or international bar associations, and if you like it, you never leave it, because you build up relationships around these associations. So today, most of my best friends are the lawyers from the IBA. Because we see each other very often, at least once a year at different meetings. It is a very enriching experience to take a part in associations like these. Because you not only meet new people, but also keep contact with them, see your friends, learn a lot discussing international legal issues.

 

Q:What is your expertise as a lawyer? And how do you balance your works at the associations and at the profession?

A:My practice area is corporate law and I still do work very actively. I manage both by simply working from hotels to airplanes, spending Saturdays at the office.

 

Q:What are the unique features of IBA that caught your attention and what was the most memorable event that you had at IBA?

A:What got my attention when I first went to IBA Congress was the world opening to me where I can meet so many new people. I also found it very interesting to work for the legal profession.

Regarding the memorable events at the IBA, Rome congress was fantastic this year. This visit in Seoul has been incredible. It is one of the highlights of my experience with the IBA.

Also, one of the unique things that had happened to me was that when I was in Tokyo, I was introduced to the Emperor and the Empress of the Japan. We spent about 10 minutes talking. We laughed together, and they were very kind to me. I can say that this was also one of the highlights of my life in IBA.

 

Q:What are your strongest agenda for your presidency?

A:First priority of my presidency would be diversity and inclusion; diversity not in terms of acceptance but in terms of inclusion. There are lots of women lawyers and minority lawyers. There might be more women lawyers than men. But you don't see enough of them in leading positions, in law firms, or in bars. I think this goes the same for other minorities.

I also want to deal with refugee crisis. I think there is a huge problem that is spreading all over the world including my country. I think bars and the lawyers must be able to help to put up some legal barometers for this problem. In Italy the bar renders free legal advice to refugees. If every bar would do that, it will make a huge difference. The problem is that refugees come to the countries without knowing what they can do, how long they can stay, if they can be arrested or deported. I want to work on legal means to help refugees. We already began talking about refugee visas.

Of course, I would keep our efforts to promote the rule of law. It is my intention to enhance the value of the rule of law, because unfortunately the rule of the law in the world is under attack, in many countries where it had been secured before. I think that it is very adequate that we lawyers protect and promote rule of law, not only because we are lawyers but because we cannot be lawyers without a firm ground for the rule of law. The profession would not exist if it wasn’t for the rule of law.

I also will deal with international trades issue. I think that legal profession can be useful to international community by setting up laws and proposing solutions to terrible tariffs wars.

And in terms of human rights which we have a very active institute for, I would like to deal with trafficking of minors, children.

 

Q:Please give brief introduction for lawyers in Korea, what can they expect from Seoul Conference?

A:I have met the organizing committee for the IBA, and they would do whatever necessary in order to make the conference fruitful e successful. It is a unique opportunity for Korea, because it would be the first big lawyers’ conference here. It is also a remarkable experience for us to come to Korea, a market which is so important. As it is not that known as other markets, expectations are really high.

I am sure that the IBA will happen in Korea again in the future, but if you take the rotation of the venues into the consideration, it won’t happen again in the very near future. It would be unfortunate if you miss next year Seoul Congress for Korean lawyers. For someone who doubts or is reluctant to join the IBA should test the Seoul Conference and see how wonderful it is. I want to say that it is going to be a big opportunity for Korean lawyers. They will have an incredible opportunity of being exposed to lawyers from all over the world. For the Rome Congress this year, we had 6,400 lawyers from more than 70 different countries. We expect the number to be similar in Seoul.

 

Q:We think that language barrier can be another obstacle for joining the conference for Korean lawyers. Does IBA provide interpretations for conferences?

A:Official language of IBA is English, but we can provide translation if deemed necessary. It is up to domestic organizers to decide which sessions require translation.

 

Q:When people come to annual conferences, can they find out what committees and meetings there are in the IBA?

A:Yes, you come to the conference, identify committees that you want to belong, introduce yourself to the committee and start working in the committee. That is exactly how your life in IBA starts.

 

Q:We have heard about retreats. Could you explain what retreats are?

A:Every committee has a retreat. It is not mandatory but almost all committees have retreats either before or after the conference. It is usually scheduled in beautiful places for 2 days. They talk to each other about specific legal issues of each committee, have specific programs and plan their year deciding what they should do next year. Committees have separate meetings during sessions. A lawyer coming to IBA should know which committee you want to join and what is going to be in retreat and see whether you want to join a retreat.

 

Q:Where is the IBA Congress going to happen in 2020?

A:It will be in Miami, Florida, U.S. 2021 will be Mexico. It is planned for about 10 years ahead. We rotate the chances all over the world not be concentrated in one sole region. On top of annual conferences, we have regional and specialized conferences as well. I would like to have at least 3 activities of IBA per year in Asia.
